CambriLearn Stars

Star Search terms and conditions

Published on the date in annexure “A”. Please read these terms, including annexure “A”, before you enter your child. By entering, you agree to them. They are free to read and download at the web address in annexure “A”, and we will email you a copy on request.

1. Who runs the Star Search

1.1

The Star Search is run by Top Dog Internet Sales (Pty) Ltd (registration number 2010/013984/07), trading as CambriLearn, of 155 West Street, Sandown, Sandton, 2031 (“CambriLearn”, “we” or “us”).

1.2

We use the Star Search to choose the learners we will invite to be CambriLearn Stars for the programme year in annexure “A” (the “programme year”). Annexure “A” contains the dates and other details of this Star Search and forms part of these terms. In these terms, “you” means the parent or guardian who enters a learner, and “your child” means that learner.

1.3

Our Terms and Conditions and Privacy Policy also apply. If they conflict with these terms on anything to do with the Star Search, these terms apply.

2. What a Star is offered

2.1

Each Star will be offered a role as a CambriLearn Star for the programme year under the CambriLearn Stars Participation Agreement (the “Participation Agreement”). The role includes: (a) cover for 100% (one hundred percent) of the Star’s CambriLearn tuition from January to December of the programme year on the Premium package for the CAPS, KABV, International British or Pearson Edexcel curriculum, with the registration fee waived (exam fees are not covered); and (b) a Stars kit and an online training session on making content. In return, the Star takes part in photo and film shoots and makes content about learning with CambriLearn, which we may use in our marketing.

2.2

The family pays for travel to shoots, which take place in Johannesburg or Cape Town. You may ask us for a free copy of the Participation Agreement at any time, including before you enter.

2.3

Being chosen is an offer of the role. You and your child are free to accept or decline it. No one is required to appear in our marketing because they entered or were chosen.

3. Who may enter

3.1

You may enter your child if, on the eligibility date in annexure “A”, your child: (a) is enrolled as a CambriLearn learner in the CAPS, KABV, International British or Pearson Edexcel curriculum, and your child’s CambriLearn fees are up to date; (b) is within the age range in annexure “A”; and (c) lives in South Africa. Your child will need to stay enrolled until the Stars are chosen.

3.2

Only a parent or guardian may enter a learner. By entering, you confirm that you have parental responsibilities and rights for your child, that your child wants to take part, and that any other parent or guardian of your child agrees to the entry.

3.3

A learner may not enter if they are the child, brother or sister of, or live in the same home as: (a) a director, employee, agent or consultant of CambriLearn or of a company in its group, including CambriLearn USA, Inc.; (b) a member of the selection panel; or (c) a director or employee of a business that helps us run or market the Star Search.

3.4

We may ask for proof of your child’s age, enrolment or residence, or of your guardianship. We may disqualify an entry that does not meet these terms at any time before the Participation Agreement is signed.

4. How and when to enter

4.1

Entries open on the date in annexure “A” and close at 23:59 on the closing date in annexure “A” (the “closing date”). We will not consider late entries.

4.2

To enter, complete the entry form at the web address in annexure “A” and upload: (a) a video of your child, no longer than the length in annexure “A”, in which your child tells us about themselves and their learning with CambriLearn; and (b) your child’s answers to the questions on the form.

4.3

Each learner may enter once. If we receive more than 1 (one) entry for a learner, we will consider the last one we receive before the closing date.

4.4

Entry is free. Your only cost is your own data or internet cost to send the entry. A short, low-resolution video is fine.

4.5

The entry should be your child’s own work, made without paid help. It should not show other children, your home address or your child’s school, or use music, logos or other material that belongs to someone else. We may disqualify an entry that breaks these rules or that we reasonably consider unsuitable.

4.6

We will email you to confirm that we have received your entry. If you do not receive a confirmation within 2 (two) business days, please contact us at community@cambrilearn.com.

5. How the Stars are chosen

5.1

A panel from CambriLearn’s marketing team will choose the Stars. The panel will consider, for example: (a) your child’s personality and how they come across on camera; (b) your child’s story and learning journey; (c) how well the entry shows what learning with CambriLearn is like; and (d) the mix of the group as a whole, such as different ages, grades and parts of the country.

5.2

The panel decides at its sole discretion. There is no draw and no element of chance. If entries are equally strong, the panel chooses between them on the same criteria, not by lot.

5.3

Before deciding, the panel may ask shortlisted families for more information or a short video call.

5.4

The panel’s decision is final. We will not give reasons for it, and no one has a right to be selected.

6. Stars, reserves and results

6.1

By the selection date in annexure “A”, the panel will choose the number of Stars and reserves in annexure “A”, with the reserves ranked in order.

6.2

We will tell the families of the Stars and reserves by email by the selection date, and tell all other entrants by email by the date in annexure “A”. We will not publish the names of entrants. We will announce the Stars only after their Participation Agreements are signed, and only as those agreements allow.

6.3

If we cannot reach a Star’s family within 3 (three) business days after we first email them, we may offer the role to a reserve.

7. Signing the Participation Agreement

7.1

To accept the role, each parent or guardian of the Star will need to sign the Participation Agreement and return it, with the documents it asks for, by the date in annexure “A”. If it is not signed and returned by then, the offer lapses and we may offer the role to a reserve. We may extend the date at our discretion.

7.2

The Participation Agreement also sets conditions for the role, including that: (a) the Star stays enrolled with CambriLearn during the programme year and the fees are paid on time; (b) the Star meets the schoolwork standard set out in the Participation Agreement; and (c) the family meets the content requirements in the Participation Agreement, including the shoots and the monthly content. If any of these conditions is not met, we may end the role immediately. The role is for the programme year only and does not renew. Any further year is our choice alone, and we may choose new Stars instead.

7.3

We may withdraw an offer, cancel an acceptance, or suspend a Star’s participation, if the learner’s CambriLearn fees were not up to date on the date we made the offer or on the date you accepted it.

8. When a reserve steps in

8.1

We may offer the role to the first reserve and then, if needed, the next reserve, if, before the reserve cut-off date in annexure “A”, a Star: (a) declines the role; (b) does not sign and return the Participation Agreement under clause 7.1, or cannot be reached under clause 6.3; (c) turns out not to meet these terms; or (d) leaves the Stars programme for any other reason, including under clause 7.3.

8.2

A reserve has no right to the role, or to any benefit, unless we offer it. A reserve who is offered the role will have 5 (five) business days to sign and return the Participation Agreement. After the reserve cut-off date, we are not obliged to replace a Star.

9. Your child’s entry

9.1

You and your child keep ownership of the entry. You allow us to store, copy and view the entry, and to share it with the panel and our service providers, only to run the Star Search.

9.2

We will not publish an entry or use it in our marketing unless: (a) it is a Star’s entry and the Participation Agreement has been signed, in which case that agreement applies to it; or (b) you give us separate written consent.

9.3

By entering, you confirm that anyone else who can be seen or heard in the entry has agreed to it.

10. Your personal information

10.1

We collect your and your child’s names and contact details, your child’s age, grade and province, and the entry. For Stars and reserves, we also collect the documents referred to in clauses 3.4 and 7.1. We use this information only to run the Star Search, check eligibility and keep the records the law requires. Giving it to us is voluntary, but we cannot consider an entry without it.

10.2

Your child is under 18 (eighteen), so we process your child’s personal information with your consent as parent or guardian. This includes any sensitive information, such as health information, that you choose to include in the entry. You may withdraw your consent at any time by emailing community@cambrilearn.com. This withdraws the entry, but does not affect anything we did before.

10.3

Only the people in clause 9.1 will see the entry, and they will keep it confidential. Our service providers may store entries on servers outside South Africa, and you consent to this. We will not sell the information or use it to market to you or your child.

10.4

Unless your child becomes a Star, we will delete the entry and the other information in clause 10.1 within 60 (sixty) days after the selection date or, for a reserve, within 60 (sixty) days after the reserve cut-off date. We will keep only a short record of each entry (names, entry date, the panel’s assessment and the outcome) for 3 (three) years after the Star Search ends, to show how the Stars were chosen, and will then delete it. A Star’s information is dealt with under the Participation Agreement.

10.5

You may ask to see, correct or delete your or your child’s information, or object to its use, by contacting our Information Officer at community@cambrilearn.com. You may also complain to the Information Regulator.

11. Changes, suspension and cancellation

11.1

We may change, suspend or cancel the Star Search at any time and for any reason, for example: too few eligible entries; a change in the law; a technical problem; suspected fraud or abuse; a risk to a learner’s safety or wellbeing; or a decision not to run the Stars programme in the programme year.

11.2

After the closing date, we will not change the selection criteria or the number of Stars and reserves, unless the law requires it or the reason is outside our control.

11.3

We will post any change on this page and email entrants. If we cancel the Star Search, we will delete entries under clause 10.4.

11.4

Entering does not give anyone a right to compensation if we change, suspend or cancel the Star Search under this clause 11.

12. Law, copies and contact

12.1

South African law governs these terms. Nothing in them limits any right you have under the Consumer Protection Act 68 of 2008 or the Protection of Personal Information Act 4 of 2013.

12.2

We will keep a copy of these terms for at least 3 (three) years after the Star Search ends. If you have a question, email community@cambrilearn.com.
